DE 2083 – PAPERLESS ORDER on [2082] Order Preliminarily Approving Settlement Among Receiver, Putative Class Plaintiffs, and Eckert Seamans. On December 24, 2024, the Receiver moved the Court to grant preliminary approval of a settlement agreement (“Proposed Settlement”) among the Receiver; Eckert Seamans Cherin & Mellott, LLC, and John Pauciulo, Esq. (collectively, “Eckert Seamans”); and certain putative class plaintiffs (“Putative Class Plaintiffs”) that had previously brought suit against Eckert Seamans in three separate class actions (“Putative Class Actions”). See [ECF No. 2081]. The Proposed Settlement would settle the Putative Class Actions and the Receiver’s own potential claims against Eckert Seamans. See id. at 3. On December 26, 2024, the Court issued an order granting preliminary approval of the Proposed Settlement (“Preliminary Approval Order”). See [ECF No. 2082]. The Proposed Settlement supersedes a prior settlement in principle among the Receiver, Eckert Seamans, and the Putative Class Plaintiffs (“Prior Settlement”), see [ECF No. 1861], which the Court preliminarily approved on May 13, 2024 (“Prior Preliminary Approval Order”), see [ECF No. 1906]. Pursuant to the Prior Settlement and Prior Preliminary Approval Order, counsel for the Putative Class Plaintiffs filed a motion requesting the Court’s approval of their attorneys’ fees (“Fees Motion”). See [ECF No. 1913]. However, because the Proposed Settlement supersedes the Prior Settlement, the Preliminary Approval Order also supersedes the Prior Preliminary Approval Order and the Fees Motion. Accordingly, the Prior Preliminary Approval Order, [ECF No. 1906], is hereby VACATED, and the Fees Motion, [ECF No. 1913], is hereby DENIED as moot. Signed by Judge Rodolfo A. Ruiz, II on 12/26/2024.
